1. Definitions and Scope
“Be3ah” or the “Store” means the be3ah.com platform and the commercial entity that owns and operates it. “Customer” means any person who uses the Store or orders a product through it. “Order” means the Customer’s offer to purchase the products selected in the shopping cart.
These Terms apply to browsing the Store, creating accounts, placing Orders, making payments, delivery, and all related services. They should be read together with the Privacy Policy, Exchange and Return Policy, Warranty Policy, and any special terms displayed on a product page or during checkout.
If there is any conflict, mandatory provisions of the laws and regulations in force in the State of Kuwait shall prevail, followed by the special terms announced for the relevant product or offer, and then these Terms.
↑ Back to top2. General Terms and Acceptance of Use
By using the Store or placing an Order, the Customer confirms that they have read, understood, and accepted these Terms. A Customer who does not agree must not use the Store or complete an Order.
The Customer must have full legal capacity to enter into a purchase contract, or use the Store with the consent of their legal guardian. The Store may not be used for unlawful purposes or in any manner that harms Be3ah, Customers, or service providers.
Be3ah may update these Terms when necessary. Updates take effect from the date they are published on the Store and do not affect Orders confirmed before that date unless the change is required by law or is more favorable to the Customer.

The Customer is responsible for ensuring that account details, addresses, and contact numbers are accurate and kept up to date, and for protecting passwords and verification codes from disclosure to others.
Be3ah must be notified immediately of any suspected unauthorized use of an account. Be3ah may suspend or restrict an account where fraud, misuse, or a breach of these Terms is suspected, subject to the Customer’s legal rights.
Guest checkout may be available. Purchasing as a guest does not relieve the Customer of the obligation to provide accurate and sufficient information to fulfill the Order.

Be3ah displays product descriptions, images, and specifications as accurately as reasonably possible. Colors or appearance may vary slightly due to screen settings, photography, or manufacturer updates that do not affect the product’s essential function.
Before placing an Order, the Customer must review the product description, size, color, model, compatibility, accessories, delivery time, and any special terms. The Customer should not rely on the image alone where the written details clarify the product.
Products, offers, and quantities are subject to stock availability. Adding a product to the cart does not reserve it before the Order is confirmed and payment is accepted where applicable.
↑ Back to top5. Prices, Promotions, and Charges
Prices are displayed in Kuwaiti dinars. Additional charges are included or excluded as clearly shown on the product page or Order summary. Delivery, installation, and optional service charges are shown before checkout.
Prices and promotions may be changed before an Order is confirmed. No change applies retroactively after confirmation, except where there is an obvious error in the price or description. In that case, Be3ah will contact the Customer to offer the correct price or cancel the affected item and refund the amount paid without charging the Customer.
Coupons and promotions are subject to their stated terms, duration, and quantities and may not be combined unless expressly permitted. Fraudulent use of coupons or creating multiple accounts to misuse a promotion is prohibited.
↑ Back to top6. Orders and Formation of the Sale Contract
Submitting an Order is an offer by the Customer to purchase. An acknowledgement of receipt does not constitute final acceptance. The Order is accepted only after the information and stock are verified, the payment method is accepted, and Be3ah sends an Order confirmation or begins processing it.
Be3ah may reject or cancel an Order before final acceptance if Customer information cannot be verified, stock is unavailable, there is a material pricing or description error, payment is declined, or there is reasonable suspicion of fraud or unauthorized resale. Any amount collected for a cancelled item will be refunded by the appropriate method.
Where an Order contains several products, Be3ah may accept some items and cancel unavailable items after notifying the Customer and refunding their value.
↑ Back to top7. Payment Methods
Subject to the options displayed at checkout, Be3ah accepts cash on delivery, KNET, Visa and Mastercard, and flexible or deferred payment through Taly and Deema. Availability may vary according to Order value, product, delivery address, and provider policies.
Taly and Deema are not available for all products or Orders. Each option appears only for eligible products on the product page, in the cart, or at checkout. The Customer may not demand Taly or Deema if the option is not displayed, and eligibility may change under provider policies and according to Order value.
The Customer confirms that they are authorized to use the selected payment method and that the information supplied is accurate. Additional verification or authentication may be performed to protect the Customer and the Store.
Be3ah does not normally retain complete card details. Transactions are processed by approved payment providers under their policies. Be3ah is not responsible for a decline or hold imposed by a bank or payment provider, but will assist within the limits of the transaction recorded by Be3ah.
↑ Back to top8. Cash on Delivery
Cash on delivery is available for eligible Orders and areas as shown at checkout. A service charge may apply where disclosed in advance in the Order summary.
Be3ah may contact the Customer to confirm the Order before processing. The Customer must prepare the amount due and accept the shipment in accordance with the confirmed Order. Repeatedly refusing confirmed Orders without a legitimate reason, or providing inaccurate information, may result in this method being restricted in the future.
The Customer retains the right to inspect the external condition of the packaging and exercise exchange, return, and warranty rights under the law and published policies. Cash on delivery does not entitle the Customer to use the product and then reject it at the door.
↑ Back to top9. KNET, Visa, and Mastercard
KNET and card transactions are subject to approval by the issuing bank, payment network, and gateway provider. The bank may require a verification code or additional authentication.
If an amount is debited but the Order is not confirmed, the Customer should not immediately repeat the payment and should contact Customer Service with the transaction reference. The release of a hold or return of funds depends on the bank and payment provider and is not fully within Be3ah’s control.
For an approved refund, the amount is returned to the original payment method whenever possible. The time for the refund to appear begins after Be3ah processes it and depends on the bank or payment provider’s processing cycle.
↑ Back to top10. Taly and Deema – Buy Now, Pay Later
Taly and Deema are available only for selected products and Orders as displayed at checkout. Availability for one product or Customer does not mean automatic availability for other products or Orders.
When Taly or Deema is selected, the Customer enters into a separate payment arrangement with that provider, subject to the eligibility, approval, limits, schedule, terms, fees, and late charges, if any, presented by the provider before acceptance.
Be3ah does not guarantee approval of financing or installments and cannot alter the provider’s decision or payment schedule. The Customer must review the provider’s terms and privacy policy before confirming the option.
If an Order is cancelled or a return is accepted, Be3ah submits the adjustment or refund request to the provider after receiving and, where necessary, inspecting the product. Scheduled payments remain due until the provider confirms that the plan has been adjusted. The Customer must therefore monitor the provider’s application and contact the provider about due dates.
Any amounts unrelated to the product price, credit effects, or provider fees are governed by the Customer’s separate relationship with the provider, without prejudice to the Customer’s mandatory rights against Be3ah in relation to the product and Order.
↑ Back to top11. Verification and Fraud Prevention
Be3ah may request reasonable additional information to verify the identity of the person placing the Order, the payment method, or the delivery address, subject to the Privacy Policy. Processing may be delayed until verification is complete.
Using another person’s card or account without authorization, submitting malicious payment claims, or exploiting technical errors or unintended prices is prohibited. Be3ah may cancel the Order and take lawful action where there is evidence of fraud.
↑ Back to top12. Delivery and Delivery Times
The expected delivery period is displayed on the product page or during checkout and depends on product type, preparation, and address: next business day for eligible products, one to two business days, or within three business days for products requiring special preparation, transportation, or installation.
The period begins on the first business day after Order confirmation and completion of payment or required verification. The Order date is not counted. Public holidays and non-working days are excluded.
Delivery times are estimates and are not guaranteed unless expressly stated otherwise. They may be affected by stock, area, weather, traffic restrictions, or force majeure. Be3ah will notify the Customer of any known material delay and offer the options available under law.
If an Order contains products with different delivery times, Be3ah may deliver them together according to the longest period or in separate shipments. No additional charge will be imposed because of a split decided by Be3ah unless the Customer agrees in advance.
↑ Back to top13. Receiving the Order and Delivery Address
The Customer must provide a clear address and an available phone number and ensure that an authorized person is present to receive the Order. Appropriate identification or a delivery code may be requested for protection.
The Customer should inspect the number of parcels and their external condition upon delivery, document any visible damage or shortage, and notify Be3ah without delay. Delay does not remove a mandatory right, but may make it more difficult to determine the cause of damage.
If delivery fails because of an incorrect address, no response, or unjustified refusal, Be3ah may reschedule delivery and charge a reasonable, actual cost disclosed in advance, or cancel the Order after contacting the Customer, taking into account the product’s nature and the Customer’s legal rights.
↑ Back to top14. Large Products and Installation
Some large products may require an appointment, a suitable elevator, access corridors and doors, or a separate installation service. The Customer is responsible for checking that the site and dimensions are suitable and preparing the site before delivery.
Delivery does not include removing doors, external lifting, or electrical, plumbing, or construction work unless expressly included. Installation and additional service charges are disclosed before approval.
A product requiring specialist installation must not be operated before it is installed according to the manufacturer’s instructions. Claims relating directly to incorrect installation or operation may otherwise be affected, without prejudice to coverage for original defects.
↑ Back to top15. Cancellation and Amendments
The Customer may request to amend or cancel an Order before processing or shipment begins, but acceptance depends on the Order stage and product type. A Customer message alone does not make a cancellation effective until Be3ah confirms acceptance.
Be3ah may cancel all or part of an Order under any provision or circumstance stated in these Terms, including unavailable quantity; an error in the product description, image, specification, or price; inability to complete delivery; declined payment; an issue identified by the fraud-prevention team; suspected account manipulation or abusive multiple Orders; failure to provide requested verification information; or any operational or legal reason preventing fulfillment.
Be3ah will contact the Customer if all or part of an Order is cancelled or if additional information is needed for acceptance or fulfillment. A request for additional information does not itself constitute final acceptance.
If Be3ah cancels a fully paid Order for any reason, Be3ah will refund the full amount collected for that Order. If part is cancelled, Be3ah will refund the full amount collected for the cancelled part without deducting a cancellation fee.
Refunds are returned to the original payment method whenever possible. If a bank transfer is required, the Customer must provide accurate bank-account details in the name of the person who placed or paid for the Order, subject to verification requirements. No refund will be paid in cash under any circumstances.
The time for funds to appear depends on the bank, card network, payment provider, Taly, or Deema after Be3ah processes the refund.
Be3ah takes reasonable steps to display product information, images, prices, and specifications accurately, but some information is supplied by a vendor or manufacturer. Be3ah does not guarantee that all information is error-free and may correct an error or cancel the affected Order with a full refund of the amount paid, while preserving the Customer’s legal rights.
Once a customized, cut-to-order, or made-to-order product has entered production, it may not be cancellable except where it is defective, non-conforming, or the law requires otherwise.
If the Customer cancels an Order and Be3ah accepts the cancellation, Be3ah will process the refund under the preceding provisions and the payment provider’s procedure.
↑ Back to top16. Exchanges and Returns
Be3ah complies with consumer rights applicable in the State of Kuwait. As a general rule, an exchange or return may be requested within 14 days from the purchase date shown on the invoice if the product remains in its original condition and is resalable, subject to the exceptions and conditions permitted by law.
Products of a special nature, products that touch the skin, health and personal-care products, perfumes, and other excluded categories are subject to the applicable statutory periods, controls, and health and safety conditions, as explained in the Exchange and Return Policy or on the invoice.
If a product is defective, not as described, or delivered damaged, the Customer is entitled to the remedy provided by law. These Terms may not reduce mandatory rights. The invoice, accessories, and packaging should be retained where possible to speed up inspection.
A return does not cover loss in value caused by use beyond normal inspection or damage caused by misuse or installation contrary to instructions, following a fair technical inspection and without prejudice to coverage for original defects.
↑ Back to top17. Warranty and After-Sales Service
Products are covered by the warranty stated on the product page, invoice, or warranty card, whether provided by Be3ah, the agent, or the manufacturer. The warranty period begins in accordance with the published document and applicable legal rules.
The warranty covers manufacturing defects under its terms and does not normally cover damage caused by misuse, accidents, liquids, modification, repair by an unauthorized party, or normal wear and tear, unless the law provides otherwise.
A warranty claim may require technical inspection. The Customer will be informed of the result and available remedy. Legal rights relating to defects and non-conformity remain effective regardless of any additional commercial warranty.

All rights in content, design, logos, text, and images owned by or licensed to Be3ah are reserved. They may not be copied, republished, or used commercially without written permission, except for ordinary personal shopping use.
Trademarks and product names belong to their respective owners. Their display does not imply a relationship beyond lawful supply or sale unless otherwise stated.
↑ Back to top19. Reviews and Customer-Submitted Content
Reviews must be truthful and based on an actual experience. They must not contain abuse, defamation, another person’s personal information, or unlawful content.
Be3ah may reject or remove content that violates these rules but will not alter the substance of a legitimate review merely because it is negative. Unless otherwise agreed, the Customer grants Be3ah a non-exclusive license to display submitted content for operating and marketing the Store.

Be3ah processes information required to create accounts, fulfill Orders, process payment and delivery, provide support, and prevent fraud in accordance with the Privacy Policy and applicable laws.
Necessary information may be shared with delivery companies, payment gateways, Taly, Deema, and technical service providers to the extent required to perform the service or comply with law.
Be3ah may send operational communications relating to an Order by phone, SMS, WhatsApp, or email. Marketing communications are subject to applicable consent and opt-out choices.

Be3ah uses reasonable care to maintain the Store and its security but does not guarantee uninterrupted or error-free availability. Maintenance and updates may be carried out when necessary.
The Store may include links to or services from third parties, such as payment and installment providers. Those services are subject to their owners’ terms. Be3ah is not responsible for their content or independent decisions, while remaining responsible for Be3ah’s own obligations relating to the sale.

These Terms do not exclude any liability or right that cannot lawfully be excluded. Be3ah is responsible for the product and Order to the extent required by applicable law.
Be3ah is not responsible for delay or failure directly caused by an event beyond its reasonable control, including disasters, general transport or communications disruption, or decisions of competent authorities, provided that Be3ah takes reasonable steps to reduce the impact, notify the Customer, and provide the remedies required by law.
Be3ah is not responsible for business or indirect losses that could not reasonably be expected from a consumer purchase. This does not affect compensation for direct damage or mandatory rights.
↑ Back to top23. Complaints and Dispute Resolution
Complaints may be submitted to Be3ah Customer Service using the contact details below, together with the Order number, a description of the issue, and supporting documents or images. Be3ah aims to respond and resolve complaints within a reasonable period.
If an amicable resolution cannot be reached, the Customer may contact the Consumer Protection Department at the Ministry of Commerce and Industry or another competent authority. These Terms do not restrict the Customer’s right to file a complaint or take legal action.
These Terms are governed by the laws of the State of Kuwait, and the courts of Kuwait have jurisdiction over disputes, without prejudice to any mandatory jurisdiction or consumer-protection remedy.
